Terms of Use
Acceptance
These Terms of Use ("Terms") govern your use of the Murmora mobile app and the murmora.io website (together, the "Service"), provided by El Sueno LLC ("we", "us"). By creating an account, downloading the app, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
What Murmora does
Murmora generates personalized sleep affirmations and plays them as audio sessions, in a guide voice or a voice you have cloned yourself. The Service is intended for reflection, relaxation, and personal practice. It is not a medical device and does not provide medical, mental-health, financial, or relationship advice.
Eligibility and your account
- You must be at least 13 years old to use Murmora. If you are under the age of majority where you live, you may use Murmora only with a parent or guardian's consent.
- You are responsible for the accuracy of the information you provide and for activity that happens under your account.
- You may delete your account at any time from inside the app or by emailing [email protected].
Subscriptions and billing
Murmora is free to download and try. Murmora Pro is offered as an auto-renewing subscription:
- Murmora Pro Monthly — $9.99 / month
- Murmora Pro Yearly — $59.99 / year
Payment is charged to your Apple ID or Google account at confirmation of purchase. Your subscription renews automatically at the same price unless auto-renew is turned off at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your Apple ID or Google account settings; cancelling stops the next renewal and you keep access through the end of the period you have already paid for. Any unused portion of a free trial is forfeited when you start a paid subscription.
Prices and product availability may change. We will give reasonable notice before any price increase takes effect for existing subscribers.
Refunds
Subscriptions and one-time purchases are billed by Apple and Google, and refunds are handled by them. Request a refund at reportaproblem.apple.com (iOS) or through the Play Store order history (Android). If a bug on our side caused you to lose credits or session output, email [email protected] and we will usually credit your account.
Voice cloning
Voice cloning is optional and opt-in. By submitting a voice recording, you confirm that the voice is your own and that you consent to its use to generate audio for your sessions. You may delete your cloned voice at any time from Settings; deletion removes the underlying recording from our voice provider as well. You may not submit recordings of any person other than yourself, and you may not use cloned voices to impersonate, defraud, or harm anyone.
Acceptable use
You agree not to:
- Use the Service for anything unlawful, harassing, defamatory, or that infringes another person's rights.
- Submit goals, affirmations, or other content that promotes self-harm, harm to others, or illegal activity.
- Reverse engineer, decompile, scrape, or attempt to extract source code or model weights from the Service, except where this restriction is prohibited by law.
- Resell, sublicense, or use the Service to build a competing product.
- Interfere with the Service's operation or attempt to access it by means other than the interfaces we provide.
We may suspend or terminate accounts that violate these Terms or that put the Service or other users at risk.
Your content
You keep ownership of the goals, affirmations, recordings, and other content you submit ("Your Content"). You grant us a worldwide, royalty-free license to store, process, and use Your Content for the purpose of operating the Service for you — generating your sessions, syncing your preferences, and providing support. We do not use Your Content to train general-purpose models.
Our content
The Service, including the app, website, audio output, guide voices, brand, and underlying software, is owned by El Sueno LLC and protected by intellectual-property laws. We grant you a personal, non-transferable, non-exclusive license to use the Service for your own non-commercial use, subject to these Terms. Audio output generated for you may be used for your personal listening; you may not redistribute, resell, or publicly perform it.
Not medical or professional advice
Murmora is a reflection and relaxation tool. It is not a substitute for professional medical, psychological, financial, or legal advice, diagnosis, or treatment. If you are in crisis or believe you may harm yourself or others, contact local emergency services or a qualified professional. Do not use Murmora while driving or operating machinery.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any particular outcome will result from its use.
Limitation of liability
To the maximum extent permitted by law, El Sueno LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claim arising out of or relating to the Service is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or USD $50.
Indemnification
You agree to indemnify and hold El Sueno LLC harmless from any claim or demand, including reasonable attorneys' fees, arising out of Your Content, your use of the Service, or your violation of these Terms.
Changes to the Service or these Terms
We may change, suspend, or discontinue features of the Service at any time. We may also update these Terms; if we make material changes, we will update the effective date above and, where appropriate, notify you in the app or by email before the change takes effect. Continued use of the Service after a change takes effect means you accept the updated Terms.
Governing law and disputes
These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-laws principles. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Maricopa County, Arizona, and you and we consent to the personal jurisdiction of those courts. Nothing in this section limits any non-waivable rights you have under the law of the place where you live.
